Guide of the employer​

As implementing Law No. (4) year 2007 of issuing the common system to extend the insurance protection to GCC citizens who work outside their countries in any member country of the council and based on clause (1) article (6) of this system. The Reference Guide of the Employer is issued to clarify the practical procedures to implement the common system to extend the insurance protection and the provisions of Law No. (24) year 2002 on retirement and pensions, amended by Law No. (33) year 2004 for Qatari, who works abroad in any member country.​

First: The Application of the System Scope:

 

Terms of Subjection:

The provisions of this system are compulsory to Qatari, who works abroad in any member country of the council, provided that the employee or the worker meets the following terms:​

  • Employee or worker must be Qatari.
  • Be subjected to the terms and provisions mentioned in Civil Retirement Law in Qatar.
  • Work to an employer subjected to the provisions of civil retirement/ social insurance law in the workplace country.

Exception of Subjection:

The following categories are excluded from the scope of the law application:

  • One who is referred to retirement in State of Qatar before 06/03/2003.
  • Employees or workers who are subjected to systems of retirement and pensions, which decides better benefits for them.
 

Beginning of Subjection

As implementing article (3) of Law No.(4) year 2007 by issuing the common system to extend the insurance protection to GCC citizens who work abroad, in a member country; the system is effective as of 01/01/2007.​

Systems Covered by the Insurance Protection

This system is limited to old age, illness and incapacity, and death insurance.

Second: Procedures of Registration and the Accepted Forms. 

Employer must register the Qatari citizen when joining work, if he meets the terms referred to in the previous clause (First), in one of GCC countries and include the following documents:

  • The registration form after it is filled and adopted by the employer in the workplace country.
  • A photocopy of the ID card (National ID).

These documents are sent by the employer to the device of the civil retirement/ social insurance of the workplace country that holds ratification and sends them to the General Retirement and social Insurance Authority in Qatar. The registration is according to the procedures in State of Qatar.

Employers are informed, by the device of civil retirement/ social insurance, of the adoption/ non-adoption of the Qatari citizen’s registration with reasons.

Employer monthly provides the device of civil retirement/ social insurance in the workplace country with the amendments that may affect the basic data (basic salary, social allowance “if any”) of the employee or the worker, the names of the new insured and who have finished their services to be sent to GRSIA in Qatar.​

Third: The Salary Subjected to Contribution

The salary subject to contributing is the basic salary plus the social allowance, “if any”.

Employer provides the device of civil retirement/ social insurance in the workplace country with the amendments that affect (the basic salary, social allowance ‘if any”) to be sent to GRSIA in Qatar by the mentioned device.

Fourth: Rates of Contributions

  • Employer bears the monthly contribution rate by (10%) of the employee’s/ worker’s contributable salary.
  • Employee / worker bears the monthly contribution rate by (5%) of the contributable salary.
  • Employee / worker bears the difference between the two rates if the employer’s proportion is less than (10%) if State of Qatar does not decide to bear that difference instead of its citizens.

​​The Qatari employee’s/ worker’s, who work to an employer in GCC countries, required contribution rates are calculated according to the contribution rates determined by law and schemes of civil retirement/ social insurance in the workplace country and the home country of the worker (State of Qatar) so it is flexible according to the rates change.​

If there are differences due to the difference of contributable salary definition in the home country of the employee/ worker (State of Qatar) and the workplace country, the Qatari employee’s/ worker’s bears the whole rate for the difference of the non contributable salary.​​​​ ​ ​

Fifth: Collecting the Monthly Contributions.

Employer deducts the required monthly contribution plus its proportion of contribution including the difference of contribution mentioned in clause fourth, and deposits them in GRSIA’s bank account ( State of Qatar) in the workplace country according to the account number below, attached with the monthly statement of the contributors names, date of payment and value of paid contributions.​

  1. The contributions are paid in local currency of the workplace country, within the determined schedule of its retirement scheme.
  2. Employer must monthly notify GRSIA in Qatar of the contributions details that are deposited in the bank account.
  3. In case of employer’s contribution payment delay according to the schedule that is determined by law, not registering all or some of his employees/ workers who are under the provisions of this system, not notifying of service termination of any of them, or paying contribution on basis of unreal wags, sanctions of civil retirement/ social insurance law are applied to employer in the workplace country. The amounts resulted by applying this clause are rights of civil retirement device in State of Qatar. They are deposited in the bank account that is prepared for this purpose. 
  4. Device of civil retirement/ social insurance in the workplace country undertakes collecting the contributions in schedule according to the rules and provisions in the workplace country.​

Sixth: Suspend and Terminate Contributing

Contributing is suspended in case of missing any subjection conditions mentioned in clause (First) or when ending service, in such case, the following should be done:

  1. Employer notifies the device of retirement/ social insurance in the workplace country if contribution suspends or a Qatari employee’s/ worker’s service ends as per a form of service end within the determined schedule in the system of the workplace country to notify GRSIA in Qatar.
  2. Employer notifies the device or retirement/ social insurance in the workplace country in case of incapacity or death of any Qatari employee or worker who are under the extension of insurance protection. The later completely undertakes the required medical reports and certificates to prove incapacity or death and send them to GRSIA in Qatar to do necessary procedures for settlement of employee’s/ worker’s dues or beneficiaries.
  3. In case of  a Qatari employee/ worker is missing, employer approves that as per procedures in the workplace country, sends the supporting documents of the missing case to the device of civil retirement/ social insurance in the workplace country that undertakes approving and sending them to GRSIA in Qatar.
  4. In case of terminating employee /worker’s service by job cancellation or non-disciplinary separation in governmental employers, authorities, general establishments, a photocopy of the approving documents of job cancellation or non-disciplinary separation should be included.
  5. State of Qatar bears for its citizens, who work in GCC countries, the cost amounts of the nominal periods and the legal due additional amounts in the end of service cases.​
